Welcome to Trainer Connect. By accessing or using our platform, you agree to these Terms of Use. Please read carefully before proceeding.

1. Acceptance of Terms

By creating an account or using any feature of Trainer Connect (available at trainerconnect.com.br and on the mobile apps), you confirm that you've read, understood, and fully accept these Terms of Use and our Privacy Policy.

If you do not agree with any of these terms, please refrain from using the platform.

2. Service Description

Trainer Connect is a SaaS (Software as a Service) platform that connects Personal Trainers and your Clients, offering:

• Creation and management of personalized workouts
• Library with over 1,300 exercises with video demonstrations
• Session and appointment scheduling
• Real-time chat communication
• Billing and payment collection (available in Brazil)
• Performance metrics and health tracking
• Contract and subscription management

3. Registration and Account

3.1 Requirements

To use Trainer Connect, you must be at least 18 years old or legally emancipated. Registration requires providing truthful, complete, and up-to-date information.

3.2 Account responsibility

You're solely responsible for keeping your login credentials (email and password) confidential. Any activity on your account is your responsibility.

3.3 Account types

• Personal Trainer: Professional who uses the platform to manage their students, workouts, scheduling, and billing (available in Brazil).
• Client: An individual who uses the platform to access workouts, schedule sessions, and make payments (available in Brazil) to their personal trainer.

4. User Responsibilities

4.1 For the Personal Trainer

• Confirm you hold the professional credentials required (e.g., professional registration) to practice as a fitness professional.
• Provide safe, tailored workout guidance for every student's profile.
• Keep your account and banking details up to date to receive payments (available in Brazil).
• Do not use the platform for illegal or fraudulent purposes.

4.2 For the Student

• Consult a doctor before starting any exercise program, especially if you have pre-existing health conditions.
• Inform your Personal Trainer of any physical limitations, injuries, or relevant medical conditions.
• Make payments within the agreed timeframes.
• Do not share your account with third parties.

5. Payments and Cancellation

5.1 Personal Trainer Subscription

Using the platform as a Personal Trainer requires an active subscription. Available plans, pricing, and features are described in the pricing page. Billing is recurring and managed via RevenueCat (Apple App Store or Google Play Store).

5.2 Payments Between Trainer and Student

Payments between Students and Personal Trainers are processed by Asaas (Asaas Gestão Financeira Instituição de Pagamento S.A.), a payment institution authorized by the Central Bank of Brazil and PCI-DSS certified. Each Personal Trainer receives payments into an account opened in their own name, with automatic payouts on every confirmed payment. Trainer Connect does not store credit card data on its servers.

A 1% platform fee is withheld from each transaction processed through the platform. Payment processing fees follow Asaas's rate table and are deducted from the Personal Trainer's account.

5.3 Cancellation Policy

The Personal Trainer can cancel their subscription at any time. Access to the platform will remain active until the end of the already-paid period. There is no prorated refund for unused time.

Cancellation of contracts between the personal trainer and student follows the terms agreed between them on the platform.

5.4 Refunds

Refund requests for payments between Students and Trainers must be handled directly between the parties. Trainer Connect may step in to help resolve disputes, but the final decision rests with the payment provider (Asaas).

5.5 Recurring credit card billing

When the Student chooses to pay the monthly fee by recurring credit card, they expressly authorize, at the moment of accepting the contract, that subsequent charges be billed to the same card, at the frequency and amount defined in that contract.

Card details are sent directly to Asaas and replaced with a token restricted to the account of the hired Personal Trainer. Trainer Connect does not receive, process, or store the card number, expiration date, or security code.

The amount charged is always the amount recorded in the contract accepted by the Student. Any change in price or billing frequency requires a new contract, accepted by the Student in the app before the next charge.

The Client can cancel the authorization at any time, either by canceling the subscription in the app or by requesting cancellation from the Personal Trainer. Once the authorization is canceled, no new charges will be made to the card.

6. Intellectual Property

All platform content — including, but not limited to, logos, text, images, icons, design, source code, and software — is the exclusive property of Trainer Connect or its licensors, protected under Brazilian intellectual property laws.

Workouts created by Personal Trainers remain the intellectual property of their respective creators. By using the platform, the Personal Trainer grants Trainer Connect a limited license to display, process, and store this content solely for the purpose of providing the service.

7. Limitation of Liability

Trainer Connect provides the platform "as is" (as is). We are not responsible for:

• Injuries, damages, or losses resulting from exercise performed under the guidance of Personal Trainers registered on the platform.
• Temporary service interruptions due to maintenance, updates, or factors beyond our control.
• Accuracy of the information provided by users, including professional credentials.
• Financial disputes between Personal Trainers and Students.

Trainer Connect's total liability under any circumstances will be limited to the amount paid by the user over the last 12 months of subscription.

8. Privacy and Data Protection

The collection, use, and storage of your personal data are governed by our Privacy Policy, which is an integral part of these Terms of Use. We recommend reading it carefully.

8.1. AI-Powered Photo Analysis

Trainer Connect offers, as an optional premium feature, AI-powered visual analysis of body assessment photos (Claude Sonnet, provided by Anthropic, PBC). This analysis generates estimates of body composition, somatotype, posture, and asymmetries to assist the Personal Trainer.

• The feature only runs after explicit consent from the Client, recorded in the app. Consent can be revoked at any time by the Student in "Profile → AI Analysis" or by the Personal Trainer on the Student's details screen.
• Photos are sent to Anthropic via a temporary signed URL, only at the moment of analysis. Anthropic does not train its models on data sent via API (zero data retention policy for enterprise customers).
• The results generated by AI are suggestions and don't replace the Personal Trainer's professional judgment, who always reviews and validates the values before saving them in the Client's assessment.
• This feature is subject to a monthly quota per trainer based on the plan. Trainers on the free plan don't have access.

9. Changes to the Terms

Trainer Connect may update these Terms of Use periodically. We will notify users of material changes by email or through a notice on the platform. Continued use after notification constitutes acceptance of the new terms.

10. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the Federative Republic of Brazil. The courts of the Comarca of São Paulo/SP are hereby elected to settle any questions or disputes arising from this instrument, waiving any other venue, however privileged it may be.
